How the Test Works

DUI/DWI Case Evaluation

The detaining officer asks the driver to blow into the breath testing machine for a long moment by placing the mouth around a tube. S/he tells the driver when to stop blowing. The machine either provides a result on the screen or on a printout.

Infrared light passing through the Breathalyzer determines your blood-alcohol content (BAC). Each state has a legal maximum blood-alcohol content level. For instance, most states are .08, but it could be .10. It is important that you know your state’s laws. Most importantly, do not take any chances with drinking and driving. Your body’s tolerance for alcohol varies greatly depending on what you have had to eat that day and your current body weight.

The results of breath testing are fairly accurate if administered properly. Law enforcement officers are National Highway Traffic and Safety Administration (NHTSA) trained to administer these tests.
