Refusing the Breath Test

If the driver refuses to submit to these tests, there are repercussions that include possible suspension of the driver’s license for up to a year. Punishment varies between states.
If the driver refuses to perform standardized field sobriety tests, or refuses blood, urine, or breath testing, his or her driver’s license may be revoked for up to one year. It is interesting to note that failing the chemical test for BAC can often result in less time with the driver’s license suspended than if the driver refuses to cooperate and take the tests the officer requests.
If you know you are guilty of driving under the influence of alcohol or drugs, your defense attorney would prefer that you politely decline to take any tests. They would rather defend your refusal to submit to tests than try to overturn evidence that you were intoxicated!
